KRUSTY GAMES Terms of Service

These Terms of Service ("Terms") govern your access to and use of games, software, websites, and other products or services provided by KRUSTY GAMES SAS ("KRUSTY GAMES", "we", "us", or "our").

By downloading, purchasing, installing, accessing, or using a KRUSTY GAMES product or service, you agree to these Terms to the extent permitted by applicable law.

If you do not agree with these Terms, you should not use the relevant product or service.

2. Scope

These Terms apply to KRUSTY GAMES products and services, including:

• PC games distributed through Steam;
• mobile games distributed through Google Play;
• mobile games distributed through the Apple App Store;
• interactive games and software intended for livestreamers or content creators;
• products sold through krustygames.com;
• our websites and associated online services; and
• future KRUSTY GAMES games, applications, or services that reference these Terms.

Specific products may be subject to additional rules or platform terms. If additional product-specific terms are provided, they apply together with these Terms.

3. Platform Terms

When accessing our products through Steam, Google Play, the Apple App Store, TikTok, or another third-party service, you must also comply with the applicable terms and policies of that platform.

KRUSTY GAMES does not control third-party platforms and is not responsible for their availability, operation, policies, or independent actions.

If a third-party platform suspends, modifies, or discontinues a feature necessary for a KRUSTY GAMES product, some functionality may become unavailable.

4. License

Subject to these Terms and any applicable platform rules, KRUSTY GAMES grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use our games or software for their intended purpose.

Purchasing a KRUSTY GAMES product does not transfer ownership of the game, software, source code, artwork, music, characters, assets, trademarks, or other intellectual property to you.

You receive a license to use the product, subject to these Terms and applicable law.

5. Intellectual Property

Unless otherwise stated, KRUSTY GAMES or its licensors own all rights in the content contained in our products, including:

• source and object code;
• game mechanics and software implementations to the extent protected by law;
• graphics;
• artwork;
• characters;
• animations;
• interfaces;
• logos;
• names and branding;
• audio;
• music owned or licensed by KRUSTY GAMES;
• text;
• level designs;
• databases; and
• other creative and technical assets.

Nothing in these Terms grants you ownership of KRUSTY GAMES intellectual property.

6. Gameplay Videos, Streaming and Content Creation

KRUSTY GAMES generally allows users to create and publish content featuring our games, including:

• gameplay videos;
• Let's Plays;
• livestreams;
• reviews;
• tutorials;
• social media clips; and
• other transformative or commentary-based content.

You may monetize such content through platforms including YouTube, Twitch, TikTok, and similar content platforms, subject to their respective rules.

This permission does not allow you to:

• redistribute our games or substantial portions of their files;
• distribute standalone KRUSTY GAMES assets;
• claim KRUSTY GAMES content as your own;
• use our intellectual property in a way that falsely suggests an official partnership, sponsorship, or endorsement;
• sell our artwork, audio, game files, or other assets separately; or
• use KRUSTY GAMES content for unlawful purposes.

We reserve the right to revoke this permission in specific cases involving abuse, infringement, fraud, or unlawful activity.

Third-party music, trademarks, or other licensed content contained in a game may be subject to separate rights and restrictions.

7. Interactive and Livestreaming Products

Some KRUSTY GAMES products are designed to interact with livestreaming or content-creation platforms.

These products may depend on third-party software, APIs, integrations, platforms, or services.

KRUSTY GAMES does not guarantee that third-party integrations will remain available or compatible indefinitely.

Changes made by TikTok or another third-party platform may temporarily or permanently affect functionality.

Users of such products are responsible for complying with the rules, terms, community guidelines, monetization policies, and other requirements of the third-party platforms they use.

Unless expressly stated otherwise, KRUSTY GAMES is not affiliated with, sponsored by, or endorsed by those third-party platforms.

8. Purchases and Payments

KRUSTY GAMES products may be sold through Steam, Google Play, the Apple App Store, our Shopify-powered website, or other authorized distributors.

Payments, refunds, chargebacks, taxes, and payment methods may be handled by the platform or payment provider through which you made the purchase.

Where a platform is the merchant or payment processor, its applicable purchase and refund rules may apply.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

9. In-App Purchases and Digital Content

Some games may offer optional in-app purchases, downloadable content, virtual items, virtual currencies, upgrades, or similar digital content.

Unless applicable law requires otherwise, virtual items and currencies:

• have no real-world monetary value;
• cannot be exchanged for real money through KRUSTY GAMES;
• are licensed rather than sold;
• may only be used within the applicable game or service; and
• may be modified or discontinued as part of changes to the game.

KRUSTY GAMES does not authorize the sale or transfer of virtual items or currencies outside officially supported systems.

10. Prohibited Conduct

When using KRUSTY GAMES products or services, you must not:

• cheat or use unauthorized cheat software;
• use bots, automation, trainers, or unauthorized modifications to gain an unfair advantage;
• hack or attempt to compromise a game or service;
• exploit bugs or vulnerabilities to obtain an unfair advantage;
• interfere with servers, networks, rankings, multiplayer systems, or other users;
• bypass security or technical restrictions;
• distribute malicious software through our services;
• impersonate KRUSTY GAMES or another person;
• fraudulently manipulate purchases, rewards, rankings, advertising, or virtual currencies;
• redistribute, sell, rent, sublicense, or commercially exploit copies of our games except where expressly authorized;
• extract and redistribute game assets;
• attempt to obtain source code through decompilation, disassembly, or reverse engineering except to the extent such restriction is prohibited by applicable law; or
• use our products in violation of applicable law.

Discovering a bug does not itself violate these Terms. We encourage responsible reporting of security vulnerabilities and significant exploits.

11. Online Services and Enforcement

Current or future KRUSTY GAMES products may include online functionality, leaderboards, multiplayer systems, usernames, community features, or other connected services.

Where reasonably necessary to protect our games, services, or users, KRUSTY GAMES may investigate suspected violations of these Terms.

Depending on the severity and circumstances of a violation, we may take proportionate action such as:

• removing illegitimate leaderboard entries;
• restricting online functionality;
• removing prohibited content;
• temporarily suspending access; or
• permanently banning access to certain online services.

Where required by applicable law, users will retain any applicable rights to contest such decisions.

12. User-Generated Content

Some KRUSTY GAMES services may introduce features allowing users to submit or display usernames, messages, levels, images, creations, or other content ("User Content").

If such functionality is provided, you remain responsible for your User Content.

You must not submit content that:

• infringes third-party rights;
• is unlawful;
• contains malicious software;
• violates applicable platform rules; or
• is otherwise prohibited by rules provided for the relevant service.

By intentionally submitting User Content for display or use through a KRUSTY GAMES service, you grant KRUSTY GAMES a non-exclusive, worldwide, royalty-free license to host, reproduce, display, transmit, and technically modify that content only as reasonably necessary to operate, provide, promote, moderate, and improve the relevant service, subject to applicable law.

Additional rules may be introduced if community or user-generated-content features become available.

13. Save Data and Game Progress

Some KRUSTY GAMES games store progress locally on your device, while others may use platform cloud-storage functionality or other systems.

You are responsible for maintaining appropriate backups where such functionality is available.

Save data may be lost or corrupted due to circumstances including:

• device failure;
• uninstalling a game;
• operating system changes;
• file corruption;
• cloud synchronization problems;
• platform failures;
• game updates;
• hardware changes; or
• actions outside KRUSTY GAMES' reasonable control.

To the maximum extent permitted by applicable law, KRUSTY GAMES does not guarantee that save data or game progress can always be preserved or recovered.

Nothing in this section excludes liability that cannot legally be excluded.

14. Updates and Changes to Games

We may update our games and services to:

• add or remove content;
• rebalance gameplay;
• fix bugs;
• improve performance;
• modify interfaces;
• maintain compatibility;
• address security issues;
• comply with platform requirements; or
• otherwise develop or maintain a product.

Game features, balancing, content, online functionality, or technical requirements may therefore change over time.

Where applicable, material changes will be made in accordance with mandatory consumer law.

15. No Guarantee of Long-Term Updates

Unless KRUSTY GAMES expressly commits otherwise for a particular product, purchasing or downloading a game does not constitute a promise that new content, updates, patches, features, or technical support will be provided indefinitely.

We may stop actively developing or updating a product.

This provision does not affect any mandatory obligation to provide updates, including security or conformity updates, where such an obligation exists under applicable consumer law.

16. Online Service Availability

Online features and third-party integrations may require servers, internet connectivity, platform services, or external providers.

We cannot guarantee uninterrupted or permanent availability of online functionality.

Services may occasionally be unavailable because of maintenance, technical failures, security incidents, platform changes, or circumstances outside our reasonable control.

Where legally permitted and reasonably necessary, online services may also be modified or discontinued.

Mandatory consumer rights remain unaffected.

17. Third-Party Services

Our games may integrate third-party services such as Steamworks, Google services, Apple services, advertising providers, or other technical platforms.

KRUSTY GAMES is not responsible for independent third-party services or content outside our reasonable control.

Your use of those services may be governed by separate terms and privacy policies.

18. Disclaimer

We aim to provide functional and enjoyable products, but software can contain errors or experience technical problems.

To the maximum extent permitted by applicable law, our services are provided without guarantees beyond those expressly provided by KRUSTY GAMES or required by law.

Nothing in these Terms excludes statutory guarantees, conformity requirements, warranties, or other rights that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, KRUSTY GAMES will not be liable for indirect, incidental, special, or consequential losses arising from the use or inability to use our services where such liability may legally be excluded or limited.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

The limitations in these Terms are therefore subject to any mandatory rights applicable in your country.

20. Termination

You may stop using our services at any time.

We may suspend or terminate access to online functionality where reasonably justified, including in cases of serious or repeated violations of these Terms, fraud, cheating, security threats, or unlawful conduct.

Termination of an online service does not grant KRUSTY GAMES rights that would override mandatory consumer protections or platform refund rights.

21. Privacy

Your use of KRUSTY GAMES services may involve the processing of personal data.

Please review the KRUSTY GAMES Privacy Policy for information about how personal data may be processed.

22. Age Requirements

Age ratings and minimum-age requirements may vary depending on the game, platform, service, and country.

Our products are not specifically directed at children unless expressly indicated otherwise for a particular product.

You must satisfy any minimum-age requirements imposed by applicable law and the platform or service through which you access a KRUSTY GAMES product.

Products intended for livestreamers or content creators may also require users to meet the minimum-age requirements of the relevant livestreaming or social-media platform.

23. Changes to These Terms

We may update these Terms when reasonably necessary to reflect changes to our services, technologies, legal requirements, security needs, or business practices.

The date at the beginning of these Terms indicates the latest revision.

Where required by applicable law, we will provide appropriate notice of material changes.

24. Governing Law

These Terms are governed by French law, without depriving consumers residing in other countries of mandatory protections granted to them by the laws applicable to them.

For consumers residing in the European Union or another jurisdiction providing mandatory consumer protections, nothing in these Terms restricts rights regarding competent courts or dispute resolution that cannot legally be waived.

25. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

26. Entire Agreement

These Terms, together with any applicable product-specific terms and policies, constitute the agreement between you and KRUSTY GAMES concerning use of the relevant services, subject to mandatory applicable law.
